1. Seller Information
These Terms and Conditions govern purchases made through the online store operated by:

(hereinafter referred to as the “Seller”)
The registered office is the Seller's official company and billing address. Customers should not send returned or claimed goods to this address unless expressly instructed to do so by the Seller.
2. Introductory Provisions
2.1 These Terms and Conditions (the “Terms”) govern, in accordance with Act No. 89/2012 Coll., the Civil Code, as amended (the “Civil Code”), the mutual rights and obligations arising in connection with purchase agreements concluded between the Seller and another natural or legal person (the “Buyer”) through the Seller's online store.
2.2 The Seller operates the online store at:
www.misteritual.com
(the “Online Store”).
2.3 Matters not expressly regulated by these Terms shall be governed by the laws of the Czech Republic, in particular the Civil Code and, in the case of consumers, Act No. 634/1992 Coll., on Consumer Protection, as amended.
2.4 Any provisions agreed individually between the Seller and the Buyer shall take precedence over these Terms.
2.5 A Consumer is any natural person who, outside the scope of their business activities or independent professional activities, enters into an agreement with the Seller or otherwise deals with the Seller.
2.6 These Terms form an integral part of every Purchase Agreement concluded between the Seller and the Buyer unless expressly agreed otherwise.
2.7 Where the Buyer is a Consumer, mandatory consumer protection provisions shall always prevail over any conflicting provision of these Terms.
3. Customer Account
3.1 The Buyer may purchase products from the Online Store without creating a customer account, unless registration is required for a particular service.
3.2 If the Buyer voluntarily creates a customer account, the account may be used to facilitate future purchases and manage information necessary for fulfilling orders.
Such information may include, in particular:
· first and last name,
· billing address,
· shipping address,
· telephone number,
· email address.
3.3 The Buyer must provide complete, accurate and truthful information and keep such information up to date.
3.4 The Buyer is responsible for maintaining the confidentiality of their login credentials and must not allow unauthorized third parties to access their account.
3.5 The Seller may temporarily restrict access to customer accounts where necessary due to maintenance, technical issues, security concerns or misuse of the Online Store.
3.6 The Seller may cancel an account where the Buyer materially breaches these Terms, uses the Online Store unlawfully or compromises the security of the Online Store.
4. Conclusion Of The Purchase Agreement
4.1 The Online Store contains information about the products offered by the Seller, including their main characteristics and prices.
Product availability is subject to stock availability.
Prices displayed in the Online Store include all applicable taxes where required by law, unless expressly stated otherwise. Shipping charges and any other additional charges are displayed separately before the Buyer submits the order.
4.2 The presentation of products in the Online Store constitutes an invitation to place an order and does not in itself constitute a legally binding offer by the Seller.
4.3 To order products, the Buyer selects the desired products and adds them to the electronic shopping cart.
The order process will normally include:
a) selected products and quantities,
b) country of delivery,
c) applicable currency,
d) delivery method,
e) payment method,
f) shipping and other applicable charges, and
g) the Buyer's identification, billing and delivery details.
4.4 Before submitting the order, the Buyer is given the opportunity to review and correct the information entered and to remove or change products in the shopping cart.
4.5 By clicking the final order button indicating an obligation to pay, such as “Pay now”, “Complete order”, “Order and pay” or an equivalent wording, the Buyer submits a binding order to the Seller.
4.6 The Seller will send an electronic confirmation to the email address provided by the Buyer.
Unless expressly stated otherwise in the confirmation, the Purchase Agreement is concluded when the Seller confirms acceptance of the Buyer's order.
4.7 The Seller may refuse or cancel an order before its acceptance, particularly where:
· the product is unavailable,
· payment cannot be processed,
· the Buyer has provided incomplete or incorrect information,
· the Seller reasonably suspects fraud or misuse,
· there is an obvious error in the price or product information, or
· fulfilment of the order would violate applicable law.
If the Buyer has already paid for an order that is subsequently cancelled, the Seller will refund the amount paid without undue delay.
4.8 Depending on the nature of the order, including its quantity, price or delivery requirements, the Seller may contact the Buyer to request additional confirmation or information before processing the order.
4.9 The Buyer agrees to the use of means of distance communication in connection with the conclusion of the Purchase Agreement.
The Buyer bears their own ordinary costs associated with internet or telephone use. Such costs shall not exceed the standard rates charged by the Buyer's telecommunications provider.
5. Technical Steps For Placing An Order
The typical steps for concluding a Purchase Agreement through the Online Store are:
· selecting a product and quantity;
· adding the product to the shopping cart;
· reviewing the shopping cart;
· entering contact, billing and delivery details;
· selecting the delivery method;
· selecting the payment method;
· reviewing the total price and order information;
· accepting or acknowledging these Terms and the Privacy Policy where required;
· submitting the order using a button clearly indicating the obligation to pay; and
· receiving an electronic confirmation from the Seller.
The exact checkout process may vary depending on the device, country, payment provider or functionality available in the Online Store.
6. Price And Payment Conditions
6.1 The Buyer may pay the purchase price using the payment methods made available during checkout.
These may include, in particular:
· payment card,
· online payment gateway,
· bank transfer,
· accelerated payment services such as Apple Pay or Google Pay, where available,
· other payment methods displayed in the Online Store.
6.2 The Buyer must pay the purchase price together with any agreed shipping or other charges displayed during checkout.
6.3 Unless expressly stated otherwise, payment must be completed before the Seller is required to dispatch the goods.
6.4 For bank transfers, the Seller may specify a payment deadline in the order confirmation or payment instructions.
6.5 The Seller may change the prices of products at any time. Price changes do not affect Purchase Agreements that have already been concluded.
6.6 Promotional codes, discounts and special offers cannot be combined unless expressly stated otherwise.
6.7 A discount code may be subject to specific conditions, including validity periods, minimum order values, selected products or customer eligibility.
7. Delivery Of Goods
7.1 The available delivery methods, delivery providers, estimated delivery times and applicable shipping charges are displayed during checkout.
7.2 The Seller may use third-party shipping and logistics providers to deliver orders.
7.3 The Buyer is responsible for providing a complete and accurate delivery address and contact details.
7.4 The Buyer must accept delivery of the goods at the agreed delivery location.
7.5 Unless otherwise agreed, the Seller will deliver the goods without undue delay and no later than within the period required by applicable law.
7.6 If delivery is unsuccessful due to circumstances attributable to the Buyer, including an incorrect address, failure to collect the parcel or refusal to accept delivery without a legal reason, the Seller may require the Buyer to reimburse reasonable and demonstrable costs incurred in connection with repeated delivery or return transportation.
7.7 The Buyer should inspect the external condition of the parcel upon delivery.
If the parcel is visibly damaged, the Buyer should notify the carrier and the Seller as soon as reasonably possible.
Failure to report visible damage immediately does not deprive a Consumer of any statutory rights arising from defective performance.
7.8 The risk of loss or damage to goods purchased by a Consumer passes to the Consumer when the Consumer or a third party designated by the Consumer, other than the carrier, takes physical possession of the goods.
8. Consumer's Right Of Withdrawal
8.1 A Consumer who purchases goods through the Online Store generally has the right to withdraw from the Purchase Agreement without giving any reason within 14 days.
8.2 The withdrawal period begins:
a) on the day the Consumer or a third party designated by the Consumer takes possession of the goods;
b) in the case of several goods ordered in one order and delivered separately, on the day the Consumer takes possession of the final item; or
c) in the case of goods consisting of several parts, on the day the Consumer takes possession of the final part.
8.3 To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by an unequivocal statement.

The Consumer may also use the model withdrawal form included at the end of these Terms.
8.4 The withdrawal deadline is met if the Consumer sends the notice of withdrawal before the 14-day withdrawal period expires.
8.5 Following withdrawal, the Consumer must return the goods to the Seller or to a location designated by the Seller without undue delay and no later than 14 days after notifying the Seller of the withdrawal.
The Consumer should contact info@misteritual.com before sending the goods in order to receive the correct return instructions and return address.
8.6 The Consumer bears the direct cost of returning the goods unless the Seller has expressly agreed otherwise.
8.7 The Seller will refund all payments received from the Consumer under the relevant Purchase Agreement, including the cost of the least expensive standard delivery method offered by the Seller.
If the Consumer selected a more expensive delivery method, the Seller is not required to reimburse the additional cost.
8.8 The refund will be made without undue delay and no later than 14 days after the Seller is informed of the Consumer's decision to withdraw.
The Seller may withhold the refund until the goods have been returned or until the Consumer provides evidence that the goods have been sent back, whichever occurs first.
8.9 The refund will generally be made using the same payment method used for the original transaction unless otherwise agreed.
The Consumer will not incur additional fees as a result of the refund.
8.10 The Consumer is liable only for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functionality.
9. Exceptions To The Right Of Withdrawal
The Consumer does not have the right to withdraw from a Purchase Agreement in cases provided for by applicable law, including, where relevant:
a) goods manufactured or customized according to the Consumer's specifications;
b) goods that deteriorate or expire rapidly;
c) sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery;
d) goods which, after delivery, have been inseparably mixed with other goods;
e) sealed audio or video recordings or computer software where the seal has been broken;
f) other cases specified in Section 1837 of the Czech Civil Code; and
g) Misté filter cartridges supplied in sealed packaging for health protection or hygiene reasons, where the seal has been broken after delivery and the cartridges are consequently unsuitable for return for those reasons, including where they have been used. This exception applies only where the statutory conditions in point (c) are met and does not affect rights relating to defective goods.
These exceptions apply only where the statutory conditions for the relevant exception are fulfilled.
10. Liability For Defective Goods
10.1 The Seller is responsible to the Consumer for ensuring that the goods are free from defects upon delivery and comply with the Purchase Agreement and applicable legal requirements.
10.2 In particular, the goods must:
a) correspond to the agreed description, type, quantity and quality;
b) possess the functionality and other agreed characteristics;
c) be suitable for the purpose for which the Consumer requires them, where the Consumer informed the Seller of that purpose and the Seller agreed to it;
d) be supplied with agreed accessories and instructions;
e) be suitable for the purposes for which goods of that type are normally used;
f) correspond to the quality or design that the Consumer may reasonably expect; and
g) comply with applicable legal requirements.
10.3 A Consumer may exercise rights arising from a defect that becomes apparent within two years of receipt of the goods, subject to applicable law.
10.4 Where a defect becomes apparent within the period during which applicable law presumes that the defect existed when the goods were received, the Seller bears the burden of proving otherwise unless such a presumption is incompatible with the nature of the goods or the defect.
10.5 Where goods are defective, the Consumer may primarily request:
· repair of the goods; or
· replacement of the goods,
unless the chosen remedy is impossible or disproportionately expensive compared with the alternative remedy.
10.6 The Seller may refuse to remove the defect if repair or replacement is impossible or would involve disproportionate costs, taking into account the circumstances.
10.7 The Consumer may request an appropriate reduction in the purchase price or withdraw from the Purchase Agreement where the conditions established by applicable law are satisfied, in particular where:
· the Seller has refused to remedy the defect;
· the Seller has failed to remedy the defect properly;
· the defect appears repeatedly;
· the defect constitutes a material breach of the Purchase Agreement; or
· it is apparent that the Seller will not remedy the defect within a reasonable period or without significant inconvenience to the Consumer.
10.8 The Consumer may not withdraw from the Purchase Agreement where the defect is insignificant, unless applicable law provides otherwise.
10.9 Rights arising from defective performance do not apply where the defect was caused by:
· normal wear and tear,
· improper use,
· failure to follow the instructions for use or installation,
· improper maintenance,
· accidental or intentional damage by the Buyer or a third party,
· modifications not authorized by the Seller or manufacturer,
· external circumstances or force majeure,
unless applicable law provides otherwise.
Normal wear resulting from the ordinary use of consumable products, including filter cartridges, does not in itself constitute a product defect. This does not exclude rights relating to a lack of conformity, including premature failure to meet the agreed or legally required durability or performance.
10.10 Where goods were sold at a reduced price specifically because of a defect that was clearly disclosed to the Buyer before purchase, the Buyer cannot subsequently claim rights relating solely to that disclosed defect.
10.11 The performance and lifespan of Misté filter cartridges may vary depending on local water quality, water pressure, frequency of use and other operating conditions. The Buyer should install, use, maintain and replace the products in accordance with the supplied instructions.
Recommended replacement intervals are estimates based on the stated usage conditions and may vary with actual use. This does not override specific product specifications, express guarantees or the Consumer's statutory rights concerning conformity, durability and performance.
11. Complaints And Warranty Claims
11.1 The Buyer should notify the Seller of a defect without undue delay after discovering it.

11.2 The Buyer should provide information reasonably necessary to identify and assess the claim, including:
· name and contact details,
· order number or other proof of purchase,
· description of the defect,
· photographs or videos where appropriate, and
· the remedy requested.
11.3 The Seller may request that the defective product be returned for inspection if this is reasonably necessary.
The Seller will provide the Buyer with appropriate return instructions.
11.4 A Consumer does not need to provide the original receipt if the purchase can be demonstrated in another credible manner.
11.5 When a Consumer submits a complaint, the Seller will provide confirmation of:
· the date the complaint was made,
· the content of the complaint, and
· the remedy requested.
11.6 After resolving the complaint, the Seller will provide confirmation of the date and manner in which the complaint was resolved, including information about any repair carried out, or a written explanation if the complaint is rejected.
11.7 Consumer complaints, including remedying the defect, will be resolved without undue delay and no later than 30 days from the date on which the complaint was submitted, unless the Seller and the Consumer agree on a longer period.
11.8 Where a complaint is justified, the Consumer is entitled to reimbursement of reasonable costs necessarily incurred in exercising their statutory rights in accordance with applicable law.
11.9 Normal wear from regular use, a gradual reduction in filtration performance consistent with the cartridge's expected service life and stated operating conditions, and routine replacement of an exhausted cartridge do not in themselves give rise to a claim for defective performance. These exclusions do not apply where the cartridge is defective or fails to meet agreed or legally required standards.
Any commercial warranty, if expressly offered, applies according to its terms and is additional to the Consumer's statutory rights; it does not replace or restrict them.
12. Ownership And Intellectual Property
12.1 Ownership of the goods passes to the Buyer in accordance with applicable law and after the conditions of the relevant Purchase Agreement, including payment of the purchase price, have been fulfilled.
12.2 All content forming part of the Online Store, including in particular:
· photographs,
· videos,
· graphics,
· designs,
· text,
· product descriptions,
· logos,
· trademarks,
· software,
· website layouts and
· other content,
may be protected by copyright, trademark law or other intellectual property rights.
12.3 The Buyer may not copy, reproduce, distribute, modify, commercially exploit or otherwise use such content without the prior permission of the Seller or the relevant rights holder, except where permitted by law.
13. Use Of The Online Store
13.1 The Buyer must not use the Online Store in a manner that:
· interferes with its operation,
· compromises its security,
· violates applicable law,
· infringes the rights of the Seller or third parties, or
· attempts to obtain unauthorized access to systems or data.
13.2 The Seller does not guarantee uninterrupted or error-free availability of the Online Store.
13.3 The Seller shall not be liable for temporary unavailability caused by maintenance, third-party services, technical failures, internet infrastructure failures, cyber incidents or circumstances beyond the Seller's reasonable control, except where such liability cannot legally be excluded.
13.4 If a gift or promotional product is provided free of charge together with purchased goods and the Consumer subsequently withdraws from the Purchase Agreement, the Consumer must also return the gift where permitted by applicable law.
13.5 Product images, colours and packaging displayed in the Online Store are illustrative. Minor variations caused by display settings, packaging updates or manufacturing tolerances do not in themselves constitute a defect, provided that the goods still meet the agreed description and characteristics and all applicable conformity requirements. This clause does not permit material changes to the ordered product or limit rights where goods differ from their description, sample or model.
13.6 Misté products are intended for filtering water used for washing and personal care, in accordance with the intended uses and operating conditions stated in the product description and instructions.
Unless expressly stated otherwise for a particular product, Misté products are not intended to produce drinking water or to make unsafe water potable and must not be used as a substitute for certified drinking water treatment systems. Any claims concerning the reduction of particular substances apply only as specified for the relevant product and under the stated conditions.
14. Personal Data
14.1 The Seller processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and other applicable data protection legislation.
14.2 Detailed information about the processing of personal data, purposes of processing, legal bases, retention periods and the rights of data subjects is provided in the Seller's Privacy Policy, available on the Online Store.
15. Complaints And Out-Of-Court Dispute Resolution
15.1 The Buyer may submit complaints concerning the Seller, products, orders or services to:

The Seller will endeavour to resolve complaints directly with the Buyer.
15.2 Disputes between the Seller and the Buyer may be resolved by the competent courts.
15.3 If a consumer dispute arising from a Purchase Agreement cannot be resolved directly between the Seller and the Consumer, the Consumer may submit a proposal for out-of-court dispute resolution to the competent consumer dispute resolution entity:

15.4 The Consumer's statutory rights to seek protection before the competent courts or other authorities remain unaffected.
16. Governing Law And Final Provisions
16.1 These Terms and Purchase Agreements concluded under them are governed by the laws of the Czech Republic.
16.2 Where the Buyer is a Consumer residing in another country, the choice of Czech law does not deprive the Consumer of protection afforded by mandatory provisions of the law of the country in which the Consumer has their habitual residence where such protection applies under European Union or other applicable law.
16.3 These Terms are drawn up in English.
Purchase Agreements may be concluded in English or in another language made available by the Seller through the Online Store.
16.4 The Seller may amend or update these Terms from time to time.
The version of the Terms applicable to a particular Purchase Agreement is the version effective at the time the Buyer submits the relevant order.
16.5 If any provision of these Terms is or becomes invalid, ineffective or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.
16.6 These Terms shall be interpreted in accordance with applicable European Union consumer protection legislation and other mandatory applicable law. Nothing in these Terms limits or excludes any mandatory rights granted to Consumers, including the protection described in clause 16.2.
16.7 The Seller is not bound by any voluntary code of conduct unless expressly stated otherwise.

These Terms and Conditions are effective from 10 September 2026.
